You expressly agree that your use of the site is at your sole risk.
To the full extent permissible by applicable law, BayviewFurniture.com disclaims all warranties, express or implied, including, but not limited to, implied warranties or merchantability and fitness for a particular purpose. BayviewFurniture.com does not warrant that this site, its servers, or e-mail sent from BayviewFurniture.com are free of viruses or other harmful components. BayviewFurniture.com will not be liable for any damages of any kind arising from the use of this site, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above, disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
Warranties
BayviewFurniture.com is a distributor only. The products sold by BayviewFurniture.com are not manufactured by BayviewFurniture.com. The products may, however, be covered by each manufacturers warranty, service, and support policy (if present). BayviewFurniture.com assigns and passes through to the customer any warranty of the manufacturer, and the customer acknowledges that it shall have recourse only under such warranties and only as against the manufacturer of the products. BayviewFurniture.com makes no representation or express warranty with respect to the product except those stated in this document. BayviewFurniture.com disclaims all other warranties, express or implied, as to any such product, including and without limitation, the implied warranties of merchantability, and fitness for a particular purpose, and any implied warranties arising from statute, trade usage, course of dealing, or course of performance.
Pricing Policy
Except where noted otherwise, the list price displayed for products on our website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The list price is a comparative priced estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that are offered as a set, the list price may represent “open stock” prices, which means the aggregate of the manufacturers estimated or suggested retail price for each of the items included in the set.
With respect to items sold by BayviewFurniture.com, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalogue may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
Please review our other policies, such as our pricing policy, posted on this site. These policies also govern your visit to BayviewFurniture.com. We reserve the right to make changes to our site, policies, and these conditions of use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that conditions shall be deemed sever able, and shall not affect the validity and enforceability of any remaining condition.
Return Policy
If the furniture has left the manufacturer, the customer is responsible for return shipping charges, and a 10% restocking fee. The customer will receive a full refund minus shipping charges as well as the restocking fee once the merchandise has been received back to our location.
If you simply do not like your furniture and would like to return it, the customer is responsible for original shipping charges, as well as return shipping charges, and a 10% restocking fee. The customer will receive a full refund minus shipping charges to and from as well as the restocking fee once the merchandise has been received back to our location.
The return will be processed on the same method of payment. It is up to the customer to notify Bayview Furniture within two business days of receiving your furniture if you would like to schedule a return. When the furniture is picked up for return, the driver will carefully inspect the furniture. If there is any damage that was NOT fully noted on the bill of lading when the furniture was delivered, the furniture CANNOT be returned. The customer takes full responsibility for charges that the shipping company may charge for making the visit to your home.
General Terms and Conditions
Please make sure you measure all doorways, hallways, stairways, and elevators necessary and make sure that the furniture can fit into your home. Please make sure that there is adequate maneuvering space for large pieces of furniture in hallways, doorways, stairways, etc… This is the customer’s responsibility. If the furniture is not able to fit in the room of your choice due to inadequate measuring, the furniture can be returned. Please see our return policy. The customer will be responsible for all charges stated in the return policy.
You should inspect your order when it arrives at your home to make sure that your order is complete, the accompanying paperwork is in order, and that the items are undamaged by their journey. In exceptional circumstances, a product may arrive suffering minor wear and tear from the shipping process, or even a minor defect that occurred at the factory. If furniture is damaged, you MUST describe the damage on the bill of lading before the driver leaves. The furniture will be returned for repair or replacement. Any item(s) returned because of damage will be repaired or replaced at the discretion of the delivery company. After resolution, the item(s) will be returned to the customer on a priority basis at no additional charge provided all delivery charges are paid in full. Item(s) found to be of manufacturer standards would be returned to you with an additional charge. Only significant problem items should be returned. Please do not refuse complete orders over one item as you would be required to pay for re-delivery fee. If you do not inspect your items upon delivery, or note in detail the damage on the bill of lading Bayview Furniture will be unable to assist you in repair or replacement of damaged merchandise.
Bayview Furniture is not responsible for any damage done to your home (walls, carpet, doorways, etc…) while furniture is being delivered.
The general turnaround time for getting your furniture is 4-7 weeks. This is subject to change depending on the availability of the furniture at the manufacturer. The specialized furniture carrier does most of the assembly. However they are not required to and will not move furniture that is already in a room, hang pictures or mirrors, or clean or dust the furniture once it is in your home. The furniture carriers will place the furniture in the room of your choice, where you want it ONLY ONCE. If you do not like where you originally specified for them to place the furniture, they will not rearrange it to your liking.
The furniture carriers will go up 2 flights of steps free of charge. Any additional flights will require an extra charge to the discretion of the delivery company. The extra charge will be due upon the delivery of your furniture. If you refuse to pay this fee, the delivery company has the right to refuse to deliver your furniture. In which case, you will have to pay a re-delivery fee, or follow the instructions in our return policy. All charges stated in the return policy will apply.
If you would like to cancel your order for any reason, please notify Bayview Furniture immediately. If the item has already been loaded on a truck to ship, or has shipped, the order cannot be cancelled. Once the items have been delivered to you, you have the right to refuse the item(s), however by doing so, you are agreeing to pay shipping charges to and from you, as well as a 10% restocking fee.
Sales Tax
Bayview Furniture is not responsible for collecting sales tax outside of the state of Mississippi. In the state of Mississippi there will be a 7% sales tax on all orders. In other states, the buyer is responsible to pay any and all use or sales tax on any and all orders. The use tax percentage will be calculated based on the particular state in which the furniture is being shipped to. Bayview Furniture does not have access to any states individual use or sales tax percentages and will not charge the buyer in any state other than the state of Mississippi.
